These Terms of Service apply to your use of www.pottingmad.com.au and to purchases made from Potting Mad.

Potting Mad is a trading name operated by SSJ Technology, ABN 44 959 835 837. In these terms, “Potting Mad”, “we”, “us” and “our” refer to that business.

1. Acceptance of these terms

By using our website or placing an order, you agree to these Terms of Service and the policies referred to on our website. If you do not agree, please do not use the website or place an order.

2. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.

3. Products and product information

We aim to describe and photograph our products accurately. However, reasonable variations may occur, particularly because some products are living, natural, handmade, made from reclaimed timber or individually painted.

Variations in colour, timber grain, knots, markings, growth, foliage, shape, dimensions and finish are part of the character of these products and are not necessarily defects.

Product colours may also appear differently depending on your screen and device settings.

4. Living products, seeds and pet products

Living plants and fresh-grown products naturally change over time and may vary from photographs. Care instructions and educational information are general guides only. Customers are responsible for considering their local conditions and the individual needs of their pets, plants and wildlife.

Pet-related information on our website is not veterinary advice. If you are concerned about an animal’s health, diet or reaction to a product, seek advice from a qualified veterinarian.

5. Prices and payment

Prices are displayed in Australian dollars and include GST where applicable. Shipping or delivery charges, if any, are displayed before checkout is completed.

Payment must be authorised before an order is accepted. Payments may be processed by Shopify and third-party payment providers. We do not receive or store your complete payment card number.

6. Orders

Submitting an order is an offer to purchase. We may contact you if we need to confirm product details, pickup arrangements, customisation or availability.

An order is accepted when we confirm it for fulfilment, dispatch it or notify you that it is ready for pickup.

We may decline or cancel an order where reasonably necessary, including where a product is unavailable, information or pricing is materially incorrect, payment is not authorised, the order appears fraudulent, or fulfilment is not reasonably possible. If we cancel an order after payment, we will refund the amount paid for the cancelled item or order.

7. Product availability

All products are subject to availability. Living, handmade, reclaimed and custom products may have limited quantities or longer preparation times.

If an ordered item becomes unavailable, we will contact you to offer an appropriate alternative, wait for new stock where suitable, or issue a refund for the unavailable item.

8. Local pickup

Local pickup is available only where shown on the product page or at checkout. Orders must be placed and paid for online before collection.

Our pickup address is not a walk-in retail store. Please wait until we confirm that your order is ready and provide pickup instructions before arriving.

9. Shipping and delivery

Shipping availability, charges and estimated preparation times are described on product pages, during checkout or in our Shipping Policy.

Delivery estimates are not guarantees. We will take reasonable steps to prepare and dispatch orders promptly, but carrier delays, severe weather, public holidays and other events outside our reasonable control may affect delivery.

10. Custom and personalised products

Custom designs and personalised products may require approval of details before work begins. Customers are responsible for checking names, wording, measurements and other supplied instructions.

Once production has started, a custom or personalised order may not be cancellable for change-of-mind reasons. This does not affect rights relating to faulty, damaged, unsafe, incorrectly supplied or incorrectly described products.

11. Cancellations and changes

Contact us as soon as possible if you need to change or cancel an order. We will try to assist, but changes cannot be guaranteed after preparation, customisation or dispatch has begun.

12. Returns, refunds and remedies

Returns and remedies are handled in accordance with our Return and Refund Policy and the Australian Consumer Law.

13. Promotions and discount codes

Promotions and discount codes may have additional conditions, including eligibility dates, minimum spend, product exclusions and limits per customer. Unless stated otherwise, discounts cannot be combined or applied retrospectively.

14. Website use

You must not misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious code, scrape the website in a way that unreasonably burdens our systems, or use the website for unlawful or fraudulent purposes.

15. Intellectual property

Unless otherwise stated, the website design, branding, text, photographs, illustrations, graphics and other original content are owned by or licensed to Potting Mad.

You may view and use the website for personal, non-commercial purposes. You must not reproduce, distribute, modify, sell or commercially exploit our original content without prior written permission, except where permitted by law.

16. Reviews and submitted content

If you submit a review, photograph, comment or other content, you confirm that you have the right to submit it and that it is not unlawful, misleading, defamatory or infringing.

You grant us a non-exclusive, worldwide, royalty-free licence to display and use that content in connection with our website, products and marketing. We may moderate or remove submitted content where reasonably necessary.

17. Third-party services and links

Our website may use or link to third-party services, including payment, delivery, review, analytics and social media services. Those services may have their own terms and privacy policies. We are not responsible for third-party websites that we do not control.

18. Website availability and information

We take reasonable care with our website, but we do not guarantee that it will always be uninterrupted, error-free or available. We may update, suspend or change website features when reasonably necessary.

19. Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising solely from use of the website. This limitation does not apply where liability cannot lawfully be excluded or limited, including liability arising under applicable consumer guarantees.

These terms are governed by the laws of Queensland, Australia. Nothing in this clause limits any rights you may have under applicable consumer protection laws.
